FORMAT OF EMPLOYMENT CONTRACT

(As per the Indian Contract Act, 1872)

This Employment Agreement is made and entered into on this [Date], at [Place], by and between:

  1. Employer: [Company Name], a company registered under [Applicable Law], having its registered office at [Address] (hereinafter referred to as the “Employer”).
  2. Employee: [Employee Name], residing at [Employee Address], (hereinafter referred to as the “Employee”).

(The Employer and Employee shall be collectively referred to as “Parties” and individually as “Party”).


1. APPOINTMENT & DESIGNATION

2. COMMENCEMENT & PROBATION PERIOD

2.1 The employment shall commence on [Start Date].
2.2 The Employee shall be on probation for a period of [Duration] Months. Upon successful completion, the employment shall continue unless terminated as per this Agreement.


3. DUTIES & RESPONSIBILITIES

3.1 The Employee shall perform the duties and responsibilities as assigned by the Employer from time to time.
3.2 The Employee shall comply with all company policies, rules, and regulations.
3.3 The Employee shall maintain professionalism and confidentiality in all matters related to the Employer’s business.


4. COMPENSATION & BENEFITS

4.1 Salary: The Employee shall be paid a salary of ₹[Amount] per [Month/Year], subject to applicable deductions.
4.2 Bonuses & Incentives: Any performance-based incentives, if applicable, shall be determined by the Employer.

5. WORKING HOURS & LEAVE POLICY

5.1 The Employee shall work from [Working Hours, e.g., 9:00 AM to 6:00 PM, Monday to Friday], subject to changes per business needs.

6. CONFIDENTIALITY & NON-DISCLOSURE

7. TERMINATION OF EMPLOYMENT

7.1 The employment may be terminated by:

  • Immediate termination due to misconduct, fraud, or breach of contract.

8. NON-COMPETE & NON-SOLICITATION

8.1 The Employee agrees not to work for or establish a competing business for a period of [Duration] Months after leaving the company.
8.2 The Employee shall not solicit the company’s clients, employees, or business partners during or after employment.


9. DISPUTE RESOLUTION & GOVERNING LAW

9.1 Any disputes arising under this contract shall first be attempted to be resolved through mutual discussion.
9.2 If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, and the courts of [Jurisdiction/City] shall have exclusive jurisdiction.
9.3 This contract shall be governed by the Indian Contract Act, 1872 and other applicable laws of India.


10. GENERAL CLAUSES

10.1 Entire Agreement: This Agreement represents the entire agreement between the parties.
10.2 Amendments: Any changes to this Agreement must be in writing and signed by both parties.
10.3 Severability: If any clause is found invalid, the remaining clauses shall still be enforceable.
